Preamble

Whether it’s on the future of work and digital life, urban trends and mobility of tomorrow, med tech and smart industries, artificial intelligence or the European start-up ecosystem, as an established networking conference, Forum UnternehmerTUM aims to connect European innovators. Forum UnternehmerTUM takes place at Munich Urban Colab bringing together a variety of experts who all share a passion for driving innovation ("Event").



1. General / Scope

1.1 These General Terms and Conditions ("GTC") apply to the participation in the Event hosted by the Organizer. Deviating terms and conditions of the participant are not valid, unless the Organizer has expressly agreed to them in individual cases.

1.2 The Organizer reserves the right to make changes and additions to these terms. Possible amendments and supplements become valid by publication on the Event website forum.unternehmertum.de ("Website").

1.3 Legally relevant declarations and notifications by the participant (e.g. setting of deadlines, notification of defects, withdrawal or reduction) must be made in writing, i.e. in written or text form (e.g. letter, e-mail). Legal formal requirements and further proof, in particular in case of doubt about the legitimacy of the declarant, remain unaffected.

1.4 References to the applicability of statutory provisions are only of clarifying nature. Even without such clarification, the statutory provisions shall therefore apply unless they are explicitly amended or expressly excluded in these GTC.



2. Registration

2.1 The registration for the participation in the Event is exclusively possible via forum.unternehmertum.de.

2.2 The effective registration by the participant requires that the participant has filled in all required fields in the order mask (each marked with "*") and has accepted these GTC and the Privacy Policy by confirming the mandatory fields (opt-in checkboxes).

2.3 The participant warrants that all data provided during registration is true and complete. If registration is made on behalf of another person, it must be ensured that the participating person knows and accepts these conditions. By completing and submitting the registration form, it is declared and guaranteed that the participant has been made aware of these GTC and has accepted these GTC.

2.4 Upon registration the participant will receive the tickets sent to the e-mail address provided by him/her.

2.5 The participant will not receive any further tickets by mail or fax. He/she is responsible for keeping and bringing the tickets to the Event.



3. Event Structure and Content

3.1 The content, structure, sequence and design of the Event as well as the selection of the person(s) of the speaker(s) shall be determined by the Organizer.

3.2 There is no legal claim to a specific speaker or a specific schedule. The Organizer may change the details of the event at any time within reasonable grounds.

3.3 Presentations at the Event will be held in German or English. There is no entitlement to interpretation/translation.

3.4 Event-related content, in particular presentations and documentation, is protected by copyright. Use of the content is permitted exclusively for the participant's own purposes. Passing on content to third parties is prohibited, regardless of the purpose and type of passing on.

3.5 Any use or exploitation of the copyrighted content beyond the respective contractual purpose, regardless of the type, in particular through duplication, distribution, exhibition, reproduction in corporeal form (right of public reproduction, i.e. lecture, performance and presentation, making available to the public, broadcasting, reproduction by means of image or sound carriers, reproduction of radio broadcasts and of making available to the public) as well as recording, digitization, storage - regardless of the form and on which carrier medium and in which technical configuration - is not permitted.

3.7 The Organizer assumes no responsibility or liability for any inaccuracies in the content of the presentations and documentation.



4. Special Provisions for the On-Premise Event

4.1 The participant must present a valid ticket at the admission control without being asked. As the right to access is granted to the person named as participant, the participant may also be asked to identify themselves with a valid official identification document. If the participant is granted admission, they will receive a non-transferable badge (e.g. an Event badge), which they must carry with them during the respective Event, specifically with respect to re-admittance after leaving the Event premises.

4.2 The Organizer is entitled to require the participants to comply with official orders or legal regulations in force at the time of the Event, for example officially prescribed protective and hygiene measures.

In order to ensure compliance with legally or officially prescribed protective and hygiene measures, the Organizer is entitled to restrict the number of persons in the entire Event area or in parts thereof. The Organizer may therefore temporarily deny participants access to the entire Event area or parts thereof.

4.3 The Organizer reserves the right to refuse admission to participants if they violate the house rules or appear aggressive or abusive or are under the influence of intoxicants. Weapons or dangerous objects may not be brought into the Event area. The Organizer exercises domiciliary rights at the Events. His instructions shall be followed. The respective house rules of the Event location must be observed during the stay on the Event premises. In the event of violations of the house rules or unauthorized ambush/guerrilla marketing measures, the participant may be excluded from further participation in the Event and asked to leave the Event premises. Further claims of the Organizer against the participant remain unaffected.



5. Change to Digital Event, Postponement, Cancellation due to Force Majeure

5.1 The Organizer reserves the right to hold the Event completely online ("Digital Event") if there is a justified interest. In the case of a Digital Event, the Organizer will ensure - as far as possible - that both the content of the Event and the possibility for participants to network with each other correspond as closely as possible to the standard of a face-to-face Event. For this purpose, the Organizer uses suitable technical means to fulfill the information and networking purpose of the respective Event. In such cases, the Organizer will inform the participants without delay.

5.2 In the Event of a postponement of the Event, the tickets shall remain valid for the new date. If the new date is not convenient for the participant, the participation can be transferred to another person.

5.3 Force majeure such as war, civil war, terrorism, riots, civil commotion, embargoes, natural disasters, fire, epidemics, pandemics, legislative activities, court decisions, official orders, or other unforeseeable circumstances for which the Organizer is not responsible and which prohibit the Organizer from executing the Event, such as without being limited to labor disputes or lawful lockouts, operational or transport disruptions, raw material procurement difficulties, entitle the Organizer to cancel the Event. The Organizer is not liable for damages and disadvantages resulting from the cancellation of the Event for the participant.



6. Liability of the Organizer

The Organizer is only liable (i) for damages caused intentionally or through gross negligence, (ii) for the culpable breach of essential contractual obligations by the Organizer, i.e. such obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the compliance of which the participant relies and may rely on, (iii) for damages caused as a result of fraudulent misrepresentation, (iv) for damages resulting from culpable injury to life, limb or health caused by a negligent breach of duty by the Organizer. In all other respects, liability on the part of the Organizer is excluded.



7. Liability of the Participants

7.1 The participant shall be liable in accordance with statutory regulations for all damages for which he/she is responsible in connection with the Event.

7.2 The participant shall indemnify the Organizer against all claims by third parties asserted in connection with the Event, insofar as the participant is responsible for such claims. This indemnification obligation also extends to any official fines and administrative offenses (e.g. for disturbing the peace, blocking escape routes, disregarding smoking bans) that may be imposed on the Organizer in connection with the Event.

9. Publication of the List of Participants

In order to enable participants to "network" and communicate with other participants during the Event, the data provided by the participant (first name, last name, title and company) will be published as part of the list of participants provided for the Event subject to the participant having agreed to this publication during the registration process (Section 2.2) (opt-in). The list of participants is not publicly viewable, it is only available digitally to other participants of the Event via a networking platform. The legitimate interest of the Organizer in processing this data lies in the purpose described above (Art. 6 para. 1 p. 1 lit. f) DS-GVO). Notwithstanding their opt-in during the registration process, the participants have the right to subsequently object to this processing by e-mail to event@unternehmertum.de or by letter or e-mail to the data protection officer of the Organizer:

10. Final Provisions

10.1 These GTC and the entire legal relationship between the parties shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), insofar as the participant is an entrepreneur.

10.2 To the extent permitted by law, Munich is agreed as the place of performance and exclusive - also international - place of jurisdiction.

10.3 Should any part of these GTC be void or voidable, the validity of the remaining provisions shall not be affected thereby. In place of the legally invalid part, it shall then be deemed agreed what comes closest to the original clause and/or what the parties would have agreed if they had known of the invalidity. The same shall apply in the event that the provisions contain a loophole.
